1. Agreement to Terms
By accessing or using 72hConcept's services, you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access our services.
2. Services Provided
72hConcept provides rapid prototyping and development services, including but not limited to:
- iOS application prototypes (demo-only, not production-ready unless specified)
- Landing pages and websites
- Logo design and branding
- Full MVP development (when specified)
Third-Party Services: Our prices include integration of third-party services (APIs, payment systems, etc.) but NOT the cost of those services. Clients must set up and pay for their own accounts with Firebase, Stripe, Twilio, etc. Setup assistance available for additional fee.
NOT Included: Ongoing hosting, domain names, App Store developer accounts ($99/year), SSL certificates, API usage fees, or any recurring costs.
3. Delivery Timeframe
Our target delivery timeframe is 72 hours (3 business days). This is a guideline, not a guarantee. Delivery begins when:
- Full payment is received and cleared
- All required assets and information are provided
- Project scope is confirmed in writing via email
Important: While we aim for 72-hour delivery, actual delivery may vary due to project complexity, workload, or unforeseen circumstances. We will notify you of any expected delays. The 72 hours refers to 3 business days (Monday-Friday, excluding UK bank holidays).
4. Payment Terms
- 100% payment required upfront before any work begins
- Accepted payment methods: Bank transfer (UK/International) or Card payment via Revolut
- PayPal is NOT accepted due to chargeback risks
- Prices are in USD unless otherwise specified
- Bank transfers may take 1-2 days to clear - work begins after funds are confirmed
- Additional features or screens beyond the package scope incur extra charges (must be paid before implementation)
- Refund Policy: Refunds are at our sole discretion. Full refunds will be issued if: (a) we cannot deliver due to illness/emergency, (b) project requirements exceed our capabilities, (c) we choose to refuse the project. Partial refunds may be considered on a case-by-case basis. Quality disputes are handled at our discretion.
UK Consumer Rights (B2C): If you are a consumer (not a business), you have a 14-day cooling-off period under the Consumer Contracts Regulations 2013. HOWEVER, by explicitly requesting we begin work within the 14-day period, you acknowledge losing your right to cancel once work has substantially begun. We will ask for your explicit consent before starting.
Business Clients (B2B): The 14-day cooling-off period does not apply to business-to-business transactions.
5. Revisions Policy
- Prototypes: Maximum 2 revisions included
- Logo Design: Maximum 2 revisions included
- Landing Pages: Maximum 2 revisions included
- Additional revisions: $200/revision
6. Intellectual Property
Upon full payment:
- All deliverables become your property
- Source code is provided for all projects
- You receive full commercial rights
- We retain the right to showcase work in our portfolio (unless NDA signed)
- We warrant the code contains no GPL/copyleft licenses that restrict commercial use
Design Inspiration: We may create designs inspired by existing apps for learning/demonstration purposes. We will not directly copy copyrighted designs for commercial use without permission.
Subcontractors: We reserve the right to use subcontractors but remain fully responsible for all deliverables and confidentiality.
7. Limited Availability
Due to high demand and our rapid delivery model, we accept a limited number of projects per month. Projects are accepted on a first-come, first-served basis.
8. Client Responsibilities
Client must provide:
- Clear project requirements before payment
- All necessary assets (logos, images, content) within 24 hours of payment
- Timely feedback and approvals (within 24 hours when requested)
- Accurate and legal content (we are not responsible for copyright violations)
- Assurance that their project does not infringe any intellectual property rights
Project Cancellation: If client fails to provide required assets or feedback within 48 hours, the project is considered abandoned. No refunds will be issued.
Right to Refuse: We reserve the right to refuse any project at our sole discretion, including but not limited to: illegal content, gambling, adult content, misleading/scam applications, or projects we deem inappropriate. Full refunds will be issued for refused projects.
9. Warranty Disclaimer & "AS-IS" Delivery
IMPORTANT: All prototypes are delivered "AS-IS" without any warranty of fitness for a particular purpose. These are PROTOTYPES for demonstration, testing, and validation - not production-ready applications.
- NO WARRANTY of merchantability or fitness for purpose
- NO GUARANTEE the prototype will meet all your requirements
- NO WARRANTY against bugs, errors, or security vulnerabilities
- Client assumes ALL RISK for using prototype in any live environment
- Bug fixes after delivery are NOT included (available at additional cost)
- Support is limited to email only during business hours
- We do NOT provide phone, WhatsApp, or video call support
- Source files (Figma/Sketch) not included unless specifically purchased
- Training/documentation is available at additional cost
10. Liability Limitations
72hConcept is not liable for:
- Loss of profits or revenue from prototype demonstrations
- App Store rejection (we provide TestFlight version, App Store approval is client's responsibility)
- Business failure or lack of user adoption
- Delays caused by incomplete or changing requirements
- Third-party service interruptions (App Store, hosting, APIs, etc.)
- Client's failure to maintain or update the delivered product
- Maximum liability is limited to the amount paid for services
11. Confidentiality & Data Protection
We maintain strict confidentiality for all client projects. NDAs available upon request.
Data Security: We implement reasonable security measures to protect your information. However, we are not liable for data breaches beyond our reasonable control. Any breach will be reported within 72 hours as required by GDPR.
Accessibility: We strive to meet WCAG 2.1 Level AA standards where possible but cannot guarantee full accessibility compliance for prototype applications. Production apps may require additional accessibility work at extra cost.
12. Termination
Either party may terminate services with written notice. Work completed up to termination point is non-refundable. If client terminates after work has begun, no refund will be issued.
13. Governing Law
For direct purchases through 72hconcept.com, these terms are governed by the laws of the United Kingdom. Any disputes will be resolved through binding arbitration.
Platform Purchases: Purchases made through Fiverr, Freelancer.com, or other platforms are governed by that platform's jurisdiction and dispute resolution process. We are not responsible for platform fees, their refund policies, or their dispute outcomes.
14. Pricing & VAT
UK Customers: Prices shown are final (VAT not applicable as we are below VAT threshold).
EU Customers: You may be responsible for your local VAT on digital services. Prices shown exclude any applicable EU taxes.
Business Customers: Please provide your VAT number if applicable for your records.
15. Complaints Procedure
We aim to resolve all complaints quickly and fairly:
- Step 1: Email your complaint to support@72hconcept.com with "COMPLAINT" in subject line
- Step 2: We will acknowledge within 2 business days and investigate
- Step 3: We will respond with resolution within 5 business days
- Step 4: If unsatisfied, you may escalate to Alternative Dispute Resolution (ADR) or Small Claims Court
Time Limit: All complaints must be raised within 30 days of delivery. Claims for damages must be brought within 6 months.
16. Force Majeure
Neither party is liable for delays caused by circumstances beyond reasonable control including but not limited to: illness, pandemic, natural disasters, war, terrorism, strikes, or internet/power outages. We will notify you promptly and refund if we cannot complete the work.
17. Severability & Entire Agreement
If any provision of these terms is found to be unenforceable or invalid, the remaining provisions will continue to be valid. These terms constitute the entire agreement between parties and supersede any prior agreements.
18. Additional Terms
- Age Requirement: You must be 18 years or older to purchase our services
- Currency: All prices in USD unless otherwise stated. Exchange rate fluctuations are client's responsibility
- Recurring Clients: Repeat customers may negotiate special rates after 3 successful projects
- Abandoned Projects: Projects with no client response for 7 days are closed. No refunds
- Partial Delivery: If we deliver 70%+ of agreed work before termination, no refund is due
- Portfolio Rights: We may use techniques/improvements from your project in future work
- Recording: We may record development for portfolio/educational content (your data will be obscured)
